Please read these terms and conditions (“terms & conditions”, “terms”) carefully before using our website operated by Daily Discounts (“us”, “we”, “our”).

1 Conditions of use

By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using the website accordingly. Daily Discounts only grants use and access of this website, its products, and its services to those who have accepted its terms.

Nothing in these Terms is intended to limit or exclude any rights afforded to consumers under the Consumer Protection Act, 68 of 2008.

3 Age restriction

You agree that all materials, products, and services provided on this website are the property of Daily Discounts, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute the Daily Discounts intellectual property in any way, including electronic, digital, or new trademark registrations.

You grant Daily Discounts a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement.

5 User accounts

As a user of this website, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password. If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.

We reserve the right to terminate accounts, edit or remove content, and cancel orders where permitted by law and in accordance with the Consumer Protection Act, 68 of 2008.

6 Applicable law

By using this website, you agree that the laws of the Republic of South Africa, including the Consumer Protection Act, 68 of 2008, will govern these Terms and Conditions.

7 Disputes

Any dispute related in any way to your use of this website or to products you purchase from us shall be resolved in accordance with the applicable dispute resolution mechanisms under South African law, including, where applicable, the National Consumer Commission and the National Consumer Tribunal.

8 Pricing, Product Information, Errors & Availability

We make every reasonable effort to ensure that all product descriptions, images, pricing, and availability information displayed on this website are accurate, complete, and current, in accordance with the Consumer Protection Act, 68 of 2008 (“CPA”).

However, errors may occasionally occur, including incorrect pricing, product descriptions, or stock availability. In such cases, we reserve the right to correct the error and, where applicable, cancel the affected order. If an order is cancelled due to an error or stock unavailability, the customer will be promptly notified and refunded in full, in line with the CPA. All prices are subject to change without prior notice and are valid only while stocks last. Placing an order does not guarantee product availability, and all orders are subject to confirmation and stock on hand at the time of processing.

8.1 Order Acknowledgement vs Acceptance

When you place an order, you will receive an automated email confirming that we have received your order and payment. This acknowledgement does not mean that your order has been accepted. An order is only accepted once we have verified product availability with our suppliers and have sent you a separate confirmation email stating that your order has been accepted and is being processed.

8.2 Pricing Errors

While we strive to ensure that all prices are accurate, errors may occasionally occur. If we discover an error in the price of a product you have ordered before your order is accepted, we will inform you as soon as possible. You will then have the option to reconfirm your order at the correct price or cancel it for a full refund. If we are unable to contact you, the order will be treated as cancelled and refunded in full.

9 Payments

All prices displayed on the Daily Discounts website are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT), as per South African tax regulations. The price shown on the product page and at checkout is the final price for the product itself, excluding any separate delivery, shipping, or collection fees, which will be clearly displayed and itemised where applicable. Upon successful completion of your order, a VAT-compliant tax invoice will be issued to you, which will detail the VAT amount separately as required by law. Payment processing and receipt of funds do not constitute acceptance of an order or confirmation of product availability.

10 Credit / Payment Methods

Daily Discounts does not provide credit directly. Any buy-now-pay-later or deferred payment options offered on the website are provided by third-party payment partners and are subject to their own terms.

11 Discount Codes, Coupons and Promotions

From time to time, Daily Discounts may issue discount codes, coupons, or run promotional offers (“Promotions”). Promotions are subject to these Terms & Conditions and any additional terms stated in the relevant Promotion email, advert, or on the website.

11.1 Validity period

Each Promotion is valid only during the stated promotion period. Unless explicitly stated otherwise, Promotions do not depend on when an email is opened or viewed. A Promotion will expire at the stated date and time (South African Standard Time – SAST).

11.2 Minimum spend

Where a minimum spend is required, it applies to the cart subtotal of qualifying items in a single transaction and excludes delivery/shipping charges, payment fees (if any), and gift cards/vouchers, unless stated otherwise.

11.3 How to redeem

Discount codes must be entered at checkout before payment is completed. Discounts cannot be applied after an order has been placed.

11.3.1 Use limits – Unless stated otherwise:

1. Only one discount code may be used per order.
2. Discount codes may be limited to one use per customer and/or one use per household/account.
3. Discount codes are not transferable, may not be sold, and have no cash value.

11.4 Exclusions and stacking

Promotions may exclude certain products, brands, categories, or sale items. Unless stated otherwise, Promotions cannot be combined with any other discount code, voucher, promotion, or store credit offer.

11.5 Order changes, cancellations, returns and refunds

1. If an order is cancelled or refunded (in whole or in part), the discount applied will be treated as used and may not be reissued, unless required by law or expressly stated otherwise.
2. Where a refund is due, refunds are processed in line with the Daily Discounts Returns Policy and applicable law. Discounts are not refundable as cash.

11.6 Misuse and errors

Daily Discounts may refuse, cancel, or reverse a Promotion where misuse, fraud, prohibited resale activity, or a technical/error-based redemption is suspected. Daily Discounts may correct obvious pricing or promotional errors.

11.7 Right to amend/withdraw

Daily Discounts may amend, suspend, or withdraw a Promotion where reasonably necessary (for example, due to system error or abuse). This will not affect orders already confirmed and paid within the valid promotion period.

12 Supplier Stock Availability & Backorders

Certain products offered on the Daily Discounts website are fulfilled directly from third-party suppliers, and stock availability for such products is dependent on supplier inventory at the time the order is processed.

If a product becomes unavailable after an order has been placed due to supplier stock constraints, we will notify the customer as soon as reasonably possible. The customer will have the option to proceed with a delayed delivery, accept a suitable alternative product, or receive a full refund.

Where an order has not yet been accepted as defined in these Terms, Daily Discounts may cancel the order due to supplier stock unavailability and will issue a full refund.

13 Indemnification

This indemnity applies only to the extent permitted by law. You agree to indemnify Daily Discounts and its affiliates and hold Daily Discounts harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

14 Limitation on liability

Daily Discounts will not be liable for any loss or damage arising from the misuse of this website, except where such liability cannot be excluded under applicable law.

Daily Discounts reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between Daily Discounts and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
